What are Anti-Dumping and Countervailing Measures?

 

Anti-dumping measures refers to measures taken to offset the injury caused by dumping. Dumping occurs when a company exports a product to a foreign market at a price lower than the price it normally charges in its domestic market


Countervailing measures, on the other hand, are imposed to counteract the effects of unfair subsidies provided by a foreign government to its exporters.

Malaysia is committed to ensuring a level playing field for its domestic industries in the face of unfair trade practices by foreign producers or exporters. The country’s countervailing and anti-dumping legislation empowers the Investigating Authority to take corrective action against imports that are dumped or subsidised, and which cause injury to the local industry.

This legal framework provides clear procedures for investigating such claims and determining the appropriate trade remedies. Malaysia’s approach is fully aligned with its rights and obligations as a member of the World Trade Organization (WTO), particularly under the WTO Agreements on Anti-Dumping and on Subsidies and Countervailing Measures.
 

 

If you are a producer, manufacturer, exporter to Malaysia, importer in Malaysia, or involved in any activity that depends on a Malaysian industry—directly or indirectly—it is important to understand dumping and subsidies. This knowledge will help you better understand Malaysia’s countervailing and anti-dumping legislation.

Domestic producers, or parties acting on their behalf, may file a petition with the Trade Practices Section, MITI via the TRIMA System, if they believe their industry is being injured by dumped or subsidised imports. The petition must be supported with evidence demonstrating occurrence of dumping, injury to the domestic industry and a causal link between the dumped imports and the alleged injury.
